Learner Terms and Conditions
1. Introduction
1.1 These Terms and Conditions (“Agreement”) govern your access to and use of the Shortcut Driving Pty Ltd platform (“Shortcut Driving”, “we”, “us”, or “our”) as a learner (“Learner”, “you”, or “your”).
1.2 By creating an account, making a booking, using the platform, or attending a lesson booked through the platform, you agree to be bound by this Agreement.
1.3 If you use a vehicle provided for a lesson or driving test booked through the platform, this Agreement also incorporates the relevant lesson, vehicle use, consent, and responsibility terms set out below.
2. Nature of the Platform
2.1 Shortcut Driving operates as a booking and coordination platform connecting learners with driving services and instructors.
2.2 Driving services made available through the platform may be provided by instructors engaged, arranged, or otherwise made available through Shortcut Driving.
2.3 Shortcut Driving facilitates bookings, payment collection, communication, and related platform operations.
2.4 Shortcut Driving does not guarantee the availability of any specific instructor, vehicle, time slot, or test outcome.
3. Acceptance and Term
3.1 This Agreement takes effect when you first access the platform, create an account, or make a booking.
3.2 This Agreement continues until terminated by you or Shortcut Driving in accordance with these Terms.
4. Eligibility and Capacity to Drive
4.1 You must hold a valid learner permit, driver licence, or any other legally required authority to participate in a booked lesson or service.
4.2 You must carry your valid permit or licence where required by law.
4.3 If you do not hold the required permit or licence at the time of the lesson or driving test, the booking may be refused and treated as used.
4.4 If the Learner is under 18 years of age, a parent or legal guardian who accepts these Terms or makes payment on the Learner’s behalf agrees to be responsible for the Learner’s compliance with this Agreement and for all fees payable.
5. Learner Account and Platform Use
5.1 You may use the platform to:
(a) create and manage a learner profile;
(b) view available instructors and services;
(c) make and manage eligible bookings;
(d) access learning-related content and platform resources; and
(e) leave reviews or feedback in accordance with these Terms.
5.2 You must ensure that all information you provide is accurate, current, and complete.
5.3 You are responsible for maintaining the confidentiality of your account login details and for all activity conducted through your account.
5.4 You must not:
(a) use the platform for unlawful, misleading, abusive, or inappropriate purposes;
(b) interfere with the operation or security of the platform;
(c) attempt to bypass the booking system or platform rules;
(d) use the platform for unrelated advertising, solicitation, or promotional activity; or
(e) contact instructors outside the platform for the purpose of avoiding platform processes or fees.
6. Bookings
6.1 A booking is confirmed only once payment has been successfully received and a confirmation is issued by Shortcut Driving.
6.2 All bookings are subject to instructor availability, vehicle availability where relevant, and operational constraints.
6.3 By making a booking, you confirm that:
(a) you have read and accepted these Terms;
(b) the information submitted for the booking is accurate; and
(c) you understand the applicable rescheduling, cancellation, and refund rules.
7. Learner Responsibilities
7.1 You agree to:
(a) arrive on time and prepared for the lesson;
(b) behave respectfully toward instructors, staff, and other road users;
(c) follow all lawful directions given during the lesson or service;
(d) comply with all road rules and legal requirements;
(e) not attend a lesson under the influence of alcohol, drugs, or any substance that may affect your ability to drive safely;
(f) disclose any relevant medical condition, restriction, or issue that may affect your driving; and
(g) ensure you are fit to drive.
7.2 You must not engage in abusive, unsafe, threatening, deceptive, or inappropriate conduct during or in connection with a booking.
7.3 Shortcut Driving or the instructor may refuse, stop, or terminate a lesson where there is a safety concern, non-compliance, or inappropriate conduct. In such cases, the booking may be treated as used.
8. Instructors and Services
8.1 Instructors and driving services are made available through the Shortcut Driving platform.
8.2 Shortcut Driving facilitates bookings and related administrative functions, but does not guarantee the conduct, availability, teaching style, or performance of any particular instructor.
8.3 To the extent permitted by law, Shortcut Driving is not liable for acts or omissions of an instructor except to the extent directly caused by Shortcut Driving’s own conduct or where liability cannot be excluded by law.
9. Consumer Rights
9.1 Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or limited.
9.2 Where liability cannot be excluded but can be limited, Shortcut Driving’s liability is limited to the maximum extent permitted by law.
10. Pricing and Payment
10.1 All prices are displayed on the Shortcut Driving platform before checkout.
10.2 All bookings must be paid in full at the time of booking unless otherwise stated.
10.3 Payment is processed immediately upon confirmation of the booking.
10.4 Payments may be processed through third-party payment providers, including Stripe and/or PayPal, and may also be subject to the terms of those providers.
10.5 By making payment, you warrant that you are authorised to use the nominated payment method.
10.6 Shortcut Driving may change lesson prices, package pricing, instructor pricing, promotional offers, and platform pricing at any time before a booking is confirmed.
10.7 Platform credits, where issued:
(a) are non-transferable;
(b) are not redeemable for cash;
(c) expire 6 months from the date of issue unless otherwise stated; and
(d) may only be used for eligible bookings on the Shortcut Driving platform.
11. Rescheduling by Learners
11.1 Learners may reschedule a lesson through their Shortcut Driving login portal only if the request is made at least 48 hours before the scheduled lesson start time.
11.2 Rescheduling is not available within 48 hours of the scheduled lesson start time.
11.3 A rescheduled booking remains subject to instructor availability and any applicable platform limits or rules.
11.4 Shortcut Driving may, in exceptional circumstances and at its absolute discretion, consider a request outside the normal rescheduling window where reasonable supporting documentation is provided. Any exception does not create an ongoing entitlement or precedent.
12. Cancellations by Learners
12.1 Learners cannot cancel a booking through the platform directly.
12.2 If you wish to cancel a booking, you must submit your request by email to Hello@shortcutdriving.com.au.
12.3 A learner cancellation request must be received at least 48 hours before the scheduled lesson start time to be eligible for consideration.
12.4 Cancellation requests received within 48 hours of the scheduled lesson start time will not be accepted.
12.5 If you do not attend a lesson, arrive too late for the lesson to proceed, fail to hold the required permit or licence, or cannot proceed because of your own non-compliance, the booking may be treated as used.
13. Refunds
13.1 Where a learner submits an eligible cancellation request under clause 12.3, Shortcut Driving may process a refund to the original payment method used at checkout.
13.2 Refunds are not available for cancellations requested within 48 hours of the scheduled lesson start time.
13.3 Refunds are not available where a learner fails to attend a lesson, is unfit to drive, does not hold the required permit or licence, or is unable to proceed due to their own conduct or circumstances.
13.4 Discounted lessons, promotional bookings, discounted packages, bundled offers, special-price bookings, and package purchases are not refundable for change of mind, cancellation, or unused sessions, except where required by law.
13.5 Any refund approved under these Terms will be returned to the original payment method used at checkout. Processing times may vary depending on the payment provider and financial institution.
13.6 Shortcut Driving is not responsible for delays caused by third-party payment providers or financial institutions in processing returned funds.
13.7 Nothing in this clause excludes any refund or remedy that may be required under the Australian Consumer Law.
14. Instructor or Platform Cancellations
14.1 If an instructor or Shortcut Driving cancels a confirmed booking, Shortcut Driving may offer, at its discretion:
(a) a replacement booking;
(b) a booking with another available instructor;
(c) a platform credit; or
(d) a refund.
14.2 Where a lesson cannot proceed due to instructor unavailability, operational issues, vehicle unavailability, or other reasons attributable to Shortcut Driving or the instructor, Shortcut Driving will use reasonable efforts to provide an appropriate remedy.
15. Promotional Offers and Discounted Packages
15.1 Promotional offers, coupon codes, discounted pricing, package deals, introductory offers, bundled services, and limited-time specials are subject to any specific terms stated at the time of booking.
15.2 Unless otherwise expressly stated, promotional discounts cannot be combined.
15.3 Where a booking or package is purchased at a discounted or promotional rate, clause 13.4 applies.
15.4 Shortcut Driving may withdraw or amend a promotion at any time before a booking is confirmed.
16. Reviews and Feedback
16.1 You may leave genuine, honest, and lawful feedback or reviews through permitted channels.
16.2 Reviews must not be false, defamatory, abusive, misleading, manipulated, incentivised without disclosure, or otherwise unlawful.
16.3 Shortcut Driving may remove or decline to publish feedback that breaches these Terms or applicable laws.
17. Use of Instructor Vehicles
17.1 Where a lesson or driving test is conducted using a vehicle made available for that service, the person conducting the lesson or test retains control over whether the vehicle is made available.
17.2 The lesson or test may be stopped or ended if this is considered necessary for safety, legal compliance, vehicle protection, or because of inappropriate conduct.
17.3 You are responsible for complying with all lawful instructions given during the use of the vehicle.
17.4 You may be liable for any loss, damage, excessive cleaning, or cost caused by your misuse, negligent conduct, unlawful conduct, or failure to follow instructions, to the extent permitted by law.
18. Driving Test and Lesson Responsibility
18.1 Shortcut Driving and instructors do not guarantee that you will pass any driving test.
18.2 Your performance in any lesson or test remains your own responsibility.
18.3 You are responsible for ensuring that you:
(a) meet the legal requirements to undertake the lesson or test;
(b) bring all required documents; and
(c) are fit, ready, and legally permitted to drive.
19. Medical and Safety Disclosure
19.1 You must disclose any medical condition, injury, restriction, or factor that may affect your ability to drive safely.
19.2 Shortcut Driving or the instructor may refuse or stop a lesson where they reasonably believe it is unsafe or unlawful for you to continue.
20. Platform Conduct and Safety
20.1 You must not:
(a) harass, threaten, abuse, bribe, or intimidate any instructor, staff member, or other person;
(b) engage in dangerous, reckless, or illegal conduct;
(c) smoke, vape, or consume prohibited substances during a lesson where not permitted; or
(d) damage any vehicle or property.
20.2 If you breach this clause, Shortcut Driving may suspend or terminate your account and may treat any affected booking as used.
21. Suspension and Termination
21.1 Shortcut Driving may suspend, restrict, or terminate your access to the platform or cancel future bookings where:
(a) you breach this Agreement;
(b) you provide false or misleading information;
(c) your conduct creates safety, legal, reputational, or operational risk; or
(d) Shortcut Driving reasonably believes such action is necessary.
21.2 You may stop using the platform at any time, but termination of your account does not affect accrued rights, completed bookings, or fees already incurred.
22. Privacy and Data
22.1 Shortcut Driving handles personal information in accordance with its Privacy Policy.
22.2 By using the platform, you consent to the collection, use, disclosure, and storage of your information as reasonably required for bookings, communication, support, compliance, and platform operations.
22.3 You must ensure that all information you submit is accurate and current.
23. Intellectual Property
23.1 All platform content, branding, text, graphics, design elements, systems, and materials made available through Shortcut Driving remain the property of Shortcut Driving or its licensors unless otherwise stated.
23.2 You must not copy, reproduce, modify, distribute, exploit, or use platform content except as permitted by law or with prior written consent.
24. Limitation of Liability
24.1 To the maximum extent permitted by law, Shortcut Driving is not liable for indirect, incidental, special, or consequential loss, including loss of opportunity, loss of income, or loss arising from missed tests or missed bookings.
24.2 To the extent permitted by law, Shortcut Driving’s liability arising out of or in connection with the platform or any booking is limited to the amount paid by you for the relevant booking giving rise to the claim.
24.3 Nothing in this clause limits liability where such limitation is not permitted by law.
25. Indemnity
25.1 You indemnify Shortcut Driving against loss, damage, liability, cost, or expense arising from:
(a) your breach of this Agreement;
(b) your unlawful, negligent, or unsafe conduct;
(c) damage caused by you to a vehicle or property; or
(d) your misuse of the platform,
except to the extent caused by Shortcut Driving’s own breach or negligence, or where such indemnity is not enforceable by law.
26. Force Majeure
26.1 Shortcut Driving is not liable for delay, cancellation, interruption, or failure to perform caused by events beyond its reasonable control, including severe weather, road closures, accidents, government restrictions, technical outages, illness, or vehicle breakdown.
26.2 Where reasonably possible, Shortcut Driving will attempt to notify affected learners and offer an alternative arrangement where appropriate.
27. Complaints and Disputes
27.1 If you have a complaint, concern, or dispute, you should first contact Shortcut Driving through the website or by email so that we can attempt to resolve the matter promptly and in good faith.
27.2 Both parties agree to first attempt informal resolution before commencing formal legal proceedings, except where urgent relief is reasonably required.
28. Changes to These Terms
28.1 Shortcut Driving may amend these Terms from time to time.
28.2 Updated Terms will take effect from the time they are published on the Shortcut Driving platform, unless otherwise stated.
28.3 The Terms in effect at the time of booking will apply to that booking unless a change is required by law or expressly stated to apply otherwise.
29. Governing Law
29.1 This Agreement is governed by the laws of the State of Victoria, Australia.
29.2 You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.
30. Severability
30.1 If any part of this Agreement is held to be invalid, void, illegal, or unenforceable, the remainder of the Agreement continues in full force and effect.
